1. Purpose

These General Terms and Conditions of Sale define the conditions applicable to the sale of products on the ESSEGE S.A. website.

Any order placed on the website implies the customer's full and unreserved acceptance of these General Terms and Conditions of Sale.

3. Products

The products offered for sale are those presented on the website at the time of consultation by the customer, within the limits of available stock.

ESSEGE S.A. strives to present the products with the greatest possible accuracy. However, photographs, visuals, descriptions, and technical information are provided for illustrative purposes only and may be modified at any time.

In the event of a product's unavailability after order validation, ESSEGE S.A. will inform the customer as soon as possible to propose an appropriate solution, such as a replacement product, delayed delivery, or a refund.

4. Price

The prices displayed on the website are indicated in euros, including all taxes, unless otherwise specified.

Delivery costs, when applicable, are indicated to the customer before final order validation.

ESSEGE S.A. reserves the right to modify its prices at any time. The applicable price is the one displayed at the time of order validation by the customer.

5. Order

The customer selects the products they wish to order and checks the contents of their cart before validating.

Before confirming their order, the customer must verify the accuracy of the information provided, particularly their contact details, billing address, and delivery address.

The order is considered final after payment confirmation, subject to product availability and validation by ESSEGE S.A.

6. Payment

Payment is made using the payment methods offered on the website at the time of the order.

The order will only be processed after payment validation. In case of payment refusal or failure, the order may be automatically cancelled.

Payment transactions are secured by the payment providers used on the website. ESSEGE S.A. does not retain the customer's full banking details.

7. Delivery

Products are delivered to the address indicated by the customer during the order, within the delivery zones offered on the website.

Delivery times are indicative. ESSEGE S.A. strives to meet the announced deadlines but cannot be held responsible for delays related to the carrier or a case of force majeure.

The customer is invited to check the condition of the package and products upon receipt. In case of a damaged, missing, or open package, the customer must make the necessary reservations with the carrier and contact ESSEGE S.A. as soon as possible.

8. Right of withdrawal

In accordance with the regulations applicable to distance selling, the consumer generally has a period of 14 calendar days from the receipt of their order to exercise their right of withdrawal, without having to justify their decision.

To exercise their right of withdrawal, the customer must clearly notify ESSEGE S.A. of their decision by email to the following address: info@essege.com.

Products must be returned in their original condition, complete, unused, and in their original packaging when possible.

Unless otherwise stated or specific legal obligation, return shipping costs are borne by the customer.

After receipt and verification of the returned products, ESSEGE S.A. will refund the amounts due within the applicable legal deadlines.

9. Exceptions to the right of withdrawal

The right of withdrawal may not apply to certain products, including products made to the customer's specifications, personalized, unsealed after delivery and which cannot be returned for reasons of hygiene or health protection, or any other product excluded by applicable regulations.

11. Legal guarantee

The products sold benefit from applicable legal guarantees, particularly in case of non-conformity or hidden defects.

12. Product use

The customer agrees to use the products in accordance with their intended purpose, user manuals, safety instructions, and manufacturer's recommendations.

ESSEGE S.A. cannot be held responsible for damages resulting from improper use, non-compliant use, lack of maintenance, or non-observance of safety instructions.

13. Liability

ESSEGE S.A. cannot be held responsible for indirect damages, loss of business, loss of data, or harm resulting from the use of the website or products, unless otherwise provided by law.

ESSEGE S.A.'s liability is limited to the amount of the order concerned, except in cases of gross negligence, intentional fault, or mandatory legal provisions to the contrary.

15. Force majeure

ESSEGE S.A. cannot be held responsible for non-performance or delay in the performance of its obligations resulting from an event of force majeure or an event beyond its control.

In the event of a dispute, the customer is invited to contact ESSEGE S.A. to seek an amicable solution.

Failing an amicable solution, the dispute may be submitted to the competent courts in accordance with applicable law.

17. Modification of the General Terms and Conditions of Sale

ESSEGE S.A. reserves the right to modify these General Terms and Conditions of Sale at any time. The applicable conditions are those in force at the time of order validation by the customer.
